BNB ISRAEL's team of dedicated professionals speaks Hebrew, English and French, providing high-end customer service to ensure that every aspect of our guests’ stay is seamless and stress-free.

This Agreement is entered between BNB ISRAEL Concierge Services (“BNB ISRAEL”, “Company”, “We”, “us”) and the guest (“Client”) of the residential property rented (“Accommodation”) by validating a reservation (“Booking”) made through the Company’s website: https://www.bnbisrael.com/ and shall take effect upon receipt of a confirmation of Booking by email.
You acknowledge and agree that by using the Company’s services for your Booking and by accepting the terms hereof, you have read, understand and agree with the terms herein as well as the relevant sections of the Company’s Terms of Service (the “Terms of Use”) as published on https://www.https://www.bnbisrael.com/terms-and-conditions into which this Agreement is incorporated.

1. Acceptance of Terms of Use

By accessing the website https://www.bnbisrael.com/ and its subpages (“Site”), you represent and warrant that you are 18 or older. Once you use any service provided by the website, create an account or register to any of the services provided by BNB ISRAEL (“Service”), you represent that you have read, understood and agreed to be bound by our Terms of Use, and by our Privacy Policy (available on our website https://www.bnbisrael.com/terms-and-conditions), including any future modifications, which shall be posted at any time and without prior notice on the Site. If you do not agree to be bound by all of the terms of this Agreement as well as those of our Privacy Policy, please cease using the Site and the Service.

2. Sign up & Communication

Basic information will be requested to create a personal account to access the Site, which may be mandatory to access certain features of the Site.
All information provided upon registration must be accurate at the time of submission and will always be kept up to date. We may use this information to contact you or for delivering the Service.
Your account is personal and cannot be shared with anyone. You may not impersonate any other person whether or not that other person is a user of the Site or of the Services.
By agreeing to these Terms you give your consent to receive communications from the Company by email.

3. Privacy Policy

BNB ISRAEL commits to treat your privacy with high protection. The collection, storage and usage of certain information about you, including among others your Personal Data, is governed by the terms of our Privacy Policy. By accessing this Service, you consent to the collection and use of information as described in our Privacy Policy, as may be amended by the Company from time to time.

This Privacy Policy also explains the rights you have concerning the Personal Data that we process and how you can exercise these rights. We manifest our commitment to privacy and data protection by embracing the following principles. We use Personal Data lawfully, fairly, and in a transparent manner. We collect no more Personal Data than necessary, and only for a legitimate purpose. We retain no more data than necessary or for a longer period than needed. 4. Cookies

We use cookies and similar tracking technologies to track the activity on our Site and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from our Site and stored on your device. Other tracking technologies are also used such as beacons, tags, and scripts to collect and track information and to improve and analyze our Site. Your Personal Data is available and accessible only by those who need the data to accomplish the intended processing purpose. To the extent necessary, your Personal Data may be shared with suppliers and subcontractors (processors and sub-processors) carrying out certain tasks on our behalf and with independent third-parties, including, but not limited to, using personal information you share with the Company or that we indirectly collect to verify your identity and for fraud prevention purposes.

The security of your data is important to the Company but remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. We may disclose your Personal Data in the good faith belief that such action is necessary to: (1) to comply with a legal obligation (2) to protect the personal safety of users of the Site or the public (3) to prevent or investigate possible wrongdoing in connection with the Site (4) to protect against legal liability.

The Service and content of the Site are available solely for personal use and for the purposes described in these Terms of Use. Any and all other uses are prohibited. BNB ISRAEL reserves the right, in its sole discretion, to refuse service, terminate account, remove or modify content, cancel reservations, or deny access to the Service.
If you publish any information on the Site, it will be your personal responsibility and liability against claims relating to breach of intellectual property, defamation, privacy or any other claim arising from your content. You may not publish any offensive, inaccurate, misleading, defamatory, fraudulent, or illegal content or content which our team deems of the above mentioned nature. If you publish any such content, your account may be terminated at our sole discretion.

BNB ISRAEL highly values your intellectual property rights and those of others. In this regard, together with the above, relating to inappropriate use, you are neither allowed to copy, to translate, to make derivative versions, to data mine, to crawl, to scrape, to reverse engineer, or to modify any part of the Site, including its source code, content and navigational structure, in any way. The Site itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, belong to BNB ISRAEL.
In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, BNB ISRAEL will promptly answer to claims of copyright infringement committed using the Site, which would be reported to BNB ISRAEL in the notice format shared below.
If you are a copyright owner, or are authorised to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to BNB ISRAEL. Upon receipt of the Notice as described below, BNB ISRAEL will take action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

DMCA Notice of Alleged Infringement ("Notice")

  1. Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the screenshot and User Profile in the BNB ISRAEL website, where such material may be found.
  3. Provide your mailing address, telephone number, and email address.
  4. Include both of the following statements in the body of the Notice:
    1. "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorised by the copyright owner, its agent, or the law (e.g., as a fair use)."
    2. "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorised to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.

6. Availability

BNB ISRAEL will use reasonable efforts to make the Services available at all times. The Services are provided over the internet and mobile networks, therefore the quality and availability of the Services may from time to time be affected by factors outside BNB ISRAEL's reasonable control. BNB ISRAEL will not be responsible whatsoever for unavailability of the Services, or any difficulty or inability to access content or any other communication system failure which may result in the Services being unavailable. It may occur that BNB ISRAEL would have to suspend access to the Site and any such interruptions shall not constitute a breach by us of these terms. We may change the format of the Site, Services provided or to the Site's content at any time without any notice.

7. Disclaimer of Warranties

In no event will BNB ISRAEL, its affiliates, employees, licensors or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, but not limited to, loss of use of the service, business interruption, loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

BNB ISRAEL’s aggregate liability to you or for all claims relating to the Service cannot exceed the amount paid, if any, by you to BNB ISRAEL for the Service.

8. Term and Termination

Your account will be terminated within 30 days following the receipt from you of an email requesting for such termination. The provisions and all obligations of and restrictions on you to the Services shall survive any termination of these Terms.
You agree that BNB ISRAEL, in its sole and absolute discretion, may terminate your account (or any part thereof) or your use of the Service, for any reason, including for lack of use or if BNB ISRAEL believes that you have violated or acted inconsistently with the spirit of these Terms. BNB ISRAEL may, also, in its sole discretion, and at any time, discontinue providing the Services, or any part thereof, without notice. You agree that any termination of your access to the Services under any provision of these Terms may be effected without prior notice, and you acknowledge and agree that BNB ISRAEL may immediately deactivate or delete your account and all related information and files in your account and prohibit any further access to all files or the Services by you; however, we do not guarantee that any information posted by you will be deleted from the Site. Further, you agree that BNB ISRAEL shall not be liable to you or any third party for any termination of your access to the Services.

9. Governing Law and Compliance

These Terms shall be governed by, construed and enforced in accordance with the laws of Israel. The parties agree that the courts of Israel shall have exclusive jurisdiction to settle any dispute which might arise out of, under, or in connection with these Terms.
Your use of the Service may also be subject to other local, national and international laws. You may be liable for civil and criminal penalties for the violations of these laws and regulations.
Any and all controversies, counts, demands, disputes claims, or causes of action (“Disputes”) between you and BNB ISRAEL or their successors or assignees shall exclusively be settled through binding and confidential arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights. You acknowledge and agree that you and BNB ISRAEL are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.

RENTING AGREEMENT

BNB ISRAEL Concierge Services

This Agreement is entered between BNB Israel Concierge Services (“Company”) and the guest (“Client”) of the residential property rented (“Accommodation”) by validating a reservation (“Booking”) made through the Company’s website: https://www.bnbisrael.com/ or by email by writing to contact@bnbisrael.com and shall take effect upon receipt of a confirmation of Booking by email.
You acknowledge and agree that by using the Company’s services for your Booking and by accepting the terms hereof, you have read, understood and agreed with the terms herein as well as the relevant sections of the Company’s Terms of Service (the “Terms of Use”) as published on https://www. https://www.bnbisrael.com/terms-and-conditions into which this Agreement is incorporated.

House Rules

The Client acknowledges and agrees that the Company requires them to agree to the below House Rules here in connection with a Booking. You agree to comply with all applicable laws and regulations, and that you will not breach any agreements you have entered into with any third parties.

Booking Confirmation

You have received a Booking Confirmation as a result of your Booking of an Accommodation.

  1. You are issued a license to occupy the Accommodation during the agreed period (“Booking Period”) set out in the Booking Confirmation. This license does not grant you any property right or interest in real estate, you are not a tenant of the accommodation. You have no right to occupy all or part of the Accommodation after the term set forth in your Booking Confirmation and have no rights to renewal or recurring usage.
  2. You cannot make any changes to the Accommodation nor can you move or remove any furnishings or other items in or on the Accommodation.
  3. The Booking Confirmation and House Rules may set forth certain restrictions, including without limitation the maximum number of occupants allowed during your use of the Accommodation, any areas of the Accommodation or items in or on the Accommodation that have been designated “no access”, noise restrictions, or limitations on pets, smoking or other activities at, on or from the Accommodation. Your license to occupy the Accommodation will be subject to immediate termination if you or any parties that occupy the Accommodation during the term of your stay violate any terms of this Agreement, the House Rules or any other agreement between you and the Company.
  4. BNB Israel Concierge Services has the right to immediately terminate the Renting Agreement and evict the occupants upon: (1) a violation of the renting agreement, including terms of use as outlined herein to which you agree to when booking this property or (2) a violation, as determined by the local police.

Booking and Cancellation

  1. The Accommodation and the Company’s services will be booked (“Booking”) between the Check-In and Check-out dates (“Booking Period”) set forth in the Booking Confirmation sent to you by email, upon validation of the Booking on the Company’s website: https://www.bnbisrael.com/ or by email by writing to contact@bnbisrael.com.
  2. Cancellation by the Client
    1. If the Client wishes to cancel the Booking requested from the Company, the Client must provide written notice of cancellation to the Company at least 30 days prior to the scheduled Check-In date. Failure to provide such notice will result in the full forfeiture of all fees paid to the Company, with the exception of cleaning fees, which shall be entirely refunded.
    2. In the event that the Accommodation becomes unavailable for the whole or any part of the Booking Period and you do not accept a suitable alternative property which is offered to you to choose from by the Company, you may then cancel the Booking, and the entirety of the fees paid to the Company will be refunded to you. The Company will not have any further liability or responsibility in respect to the cancellation of the Booking.
  3. Cancellation by the Company
    1. The Company reserves the right to cancel the Booking requested from the Company by the Clients at any time due to unforeseen circumstances, including but not limited to, acts of God, riots, war, terrorist act, epidemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, fire, explosion, extreme weather conditions, natural disasters, or other events beyond the control of the Company. In such cases, the Company will notify the Client as soon as possible and provide a full refund of any fees paid to the Company.
  4. Refunds
    Refunds for cancelled services will be provided as follows:
    1. Cancellation by the Client with at least 30 days’ notice: Full refund of any fees paid to the Company.
    2. Cancellation by the Client with less than 30 days’ notice: No refund will be provided.
    3. Cancellation by the Company: Full refund of any fees paid to the Company.
  5. Non-Refundable Fees
    The following fees are non-refundable:
    1. Credit card processing fees of 3% of the amount processed.

Payment dues

  1. By accepting the Booking Confirmation, you acknowledge and accept the responsibility to make payment of the Accommodation Fees without any deductions or offsets. Additionally, you agree to cover any expenses associated with damages to the Accommodation or its contents. In the event that you fail to vacate the Accommodation on the scheduled Check-Out date and time, you will also be responsible for compensating the Company for any fees, costs, and expenses incurred as a result of the delay, including any loss resulting from the inability to book the Accommodation for subsequent periods. This includes, but is not limited to, costs associated with finding alternative accommodation for other potential guests.The Accommodation Fees set out in the Booking Confirmation will include the fees payable with respect to the Accommodation only and all taxes payable with respect thereto.
  2. Once you have agreed to these terms, you are obligated to pay the full amount of the Accommodation Fees. The Company will collect this amount, as indicated in the Booking Confirmation, by charging the credit or debit card that you have provided.
    In the event that you do not check-in to the Accommodation on the scheduled commencement date of your booking, it is important to note that you will still be held accountable for payment of the entire Accommodation Fees for the booking, including any applicable taxes. The credit or debit card that you provided at the time of booking will be charged for the full amount due.
  3. Along with the fees and charges for the Accommodation, any taxes or fees required by governmental authorities that are applicable to your Booking may also be collected and remitted. It should be noted that the Company cannot be held responsible for any taxes that may arise from your stay in the Accommodation.

Authorization for Credit Card

At the beginning of your stay in the Accommodation, it will be necessary for you to authorize a specific amount on a credit or debit card account that you have provided. Please note that this card or account may differ from the one that you used for booking. The Company reserves the right to charge this credit or debit card in case of any damage to the Accommodation or its contents, or if you overstay past the scheduled check-out time.

Check-In and Check-Out Procedures

As indicated in the Booking Confirmation, the Check-In and Check-Out times for the Accommodation are strictly enforced. If the Company has not agreed in writing to a late Check-Out or an extension to your stay, then you will be held responsible for a full day's Accommodation Fee for any overstaying beyond the Check-Out time on your scheduled departure date. If you exceed the allotted time by more than two hours, the Company reserves the right to enter the Accommodation or send an authorized agent to remove your belongings, change the locks, and take any other necessary or appropriate action. Any costs associated with such actions will be charged to the debit or credit card account that you provided during check-in. Additionally, you will be charged an extra fee equivalent to 150% of the daily rate for each day, or partial day, that you overstay. You will also be responsible for any damages, fees, costs, or expenses incurred by the Company, including, but not limited to, any losses due to the inability to book the Accommodation for subsequent periods or the cost of finding alternative accommodations for any subsequent guest who had booked the Accommodation for the same period as your overstay.

Safety and Conduct

  1. It is your responsibility to ensure your own safety as well as anyone accompanying you during your stay at the Accommodation. You must read and follow any fire or health & safety guidelines provided to you and seek clarification if you have any questions or concerns. If you identify any health & safety risks during your stay, you must notify the Company immediately. The Company will have access to the Accommodation at all times during your stay to address any issues.
  2. You must adhere to the Terms and this Agreement, as well as any building regulations and House Rules, and comply with any reasonable requests from the Company. Only the person listed in the Booking Confirmation is allowed to occupy the Accommodation, with additional guests as specified in the Booking Summary. This Agreement is non-transferable and personal to you. The Company will not allow access or occupancy to anyone not listed in the Booking Summary.
  3. The Booking Summary may stipulate the maximum number of guests authorized to stay in the Accommodation. If you exceed this limit, you will be charged a supplement of up to 100% of your effective daily rate for each unauthorized guest, and your booking may be terminated immediately.
  4. In addition to complying with the Terms, this Agreement and House Rules, you must also keep the Accommodation clean and tidy, not bring pets or animals unless specified in the Booking Summary, not breach any Accommodation consents or insurance requirements, not obstruct common areas, not cause a nuisance or disturbance to anyone in the building or neighboring properties, not conduct illegal or commercial activities, not make alterations to the Accommodation or invade the owner's privacy, and not access any restricted areas.
  5. You must indemnify the Company for any costs, claims, damages, liabilities, and expenses resulting from your breach of this Agreement. Failure to comply with this Agreement may result in the termination of your account with the Company.
  6. To prevent any loss or damage to the building, structures, or occupants, you agree to take necessary precautions such as locking doors at night and obtaining trip and damage insurance for your stay.

Water Damage

  1. To prevent water damage, it is essential to inspect the washing machine, fridge, water heater, air conditioner, and other major appliances during your stay. Look for kinks, cracks, or damage to the drain lines or water hoses.
  2. If you plan to leave the property for an extended period, turn off the main water valve completely, and drain all the pipes to avoid freezing. Alternatively, leave the dwelling heated to at least 60 degrees Fahrenheit.
  3. In mountainous regions where temperatures drop below 60 degrees Fahrenheit during the day or night, make sure to leave indoor and outdoor pipes dripping to prevent them from freezing or bursting.
  4. During your stay, regularly check around sinks and toilets for leaks that could worsen over time. If left unchecked, these issues could lead to costly damages, including mold repair and rotten flooring for which you may be responsible.

Fire Damage

  1. When using cooking appliances that generate heat, such as gas or flame, ensure that you maintain them properly and have a fire extinguisher in the kitchen.
  2. Overloading electrical outlets and extension cords should be avoided at all costs.
  3. Never block a baseboard heater to prevent fire damage.
  4. Always keep an eye on burning candles and never leave them unattended.

Property Damage

  1. It is important to inform the Company of any damage to the accommodation, contents, fixtures, or fittings that occurred during your stay, regardless of whether you believe it is minimal or normal wear and tear or if you think it is not your fault. The company may have taken a written or video inventory before your arrival.
  2. If you fail to report any damage, you will be held fully responsible for it, and you will have to pay the full replacement cost.
  3. If you declare any damage, you will still be responsible for paying the full replacement cost.
  4. You have authorized the company to charge any property damage for which you are responsible to the credit or debit card account provided by you. The company has obtained a pre-authorization for such charges as noted in the agreement. Any charges for property damage will be charged to the credit or debit card account that you have supplied.

Liability and Claims

  1. The Company is not responsible for any business, financial, or economic loss, or any consequential, incidental, special, or indirect losses resulting from this agreement, the Accommodation, or the booking, whether due to the negligence, breach of contract, tort, or otherwise by the the Company. The limitation of liability outlined in the Terms also applies here.
  2. The Company’s liability for any losses, including property damage, personal injury, and death, arising from breach of contract, tort, negligence, or any other cause, will be limited to the cost of securing a replacement accommodation for the agreed booking period or the amount of the Accommodation Fees and charges payable by you, whichever is greater, subject to any exceptions set forth in applicable law.
  3. The Accommodation is a private residence, and the Company is not responsible for any accidents, injuries, illnesses, including but not limited to contracting Covid19, or loss of personal property or valuables incurred during your stay. You should obtain any necessary vacation, travel, or rental insurance for your stay.
  4. You agree to indemnify and hold the the Company harmless from any liability, claims, loss, property damage, or expenses arising from injury, illness, death, or damage sustained by any person or property, including yourself, any visitors, or invitees you allow to enter the Accommodation or the premises, if caused by your negligence, willful or intentional act or omission, or by any of your visitors or invitees.
  5. If the Company needs to engage an attorney to enforce this agreement, the Terms, or the House Rules, or to collect any amount owed, or to remove you or your belongings from the Accommodation, you will be responsible for all reasonable attorneys' fees and costs incurred.

Disclaimer of Warranties

Please note that your use of the Site and BNB Israel Concierge Services is entirely at your own risk. The Company’s Parties, including our affiliated companies, employees, founders, executives, agents, third-party providers, and licensors, do not guarantee uninterrupted or error-free access to the Site or Services, nor do we guarantee the accuracy, reliability, or content of any information, accommodations, services, or merchandise provided through the Site. The Site and Services are provided on an "as is" basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, except for warranties that are implied by law and cannot be excluded or modified.
We, and the Company’s Parties, shall not be held liable for any damages or injuries arising from any failures of performance, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, computer viruses, communication line failures, theft, destruction, or unauthorized access to, alteration of, or use of record, regardless of the cause of action.
You acknowledge and agree that you assume all risks associated with using the Site and Services to the fullest extent permitted by law. We and the Company’s Parties are not responsible for any defamatory, offensive, or illegal conduct of other users or third parties, including third-party platforms, and you agree that the risk of injury from the foregoing rests entirely with you.
Under no circumstances shall we, the Company’s Parties, or any person or entity involved in creating, producing, or distributing the Site or Services be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or BNB Israel Concierge Services. You acknowledge that this section applies to all content on the Site and all such services.
We and the Company’s Parties shall not be held liable for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within the Site, including without limitation pricing or availability information, or for any delay or interruption in its transmission to you, or for any claims or losses arising from or occasioned thereby.
None of the Company’s Parties shall be held liable for any third-party claims or losses of any nature, including but not limited to lost profits, punitive or consequential damages. The total liability of us and the Company’s Parties to you or any end-user for all damages, injuries, losses, and causes of action arising from or relating to these Terms or the use of or inability to use the Site or the Company’s Services shall be limited to proven direct damages in an amount not to exceed one hundred dollars ($100).
Some jurisdictions do not allow the limitation or exclusion of certain liability or warranties, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Please consult your local laws for any restrictions or limitations regarding the exclusion of implied warranties.

Indemnity

You agree to defend, indemnify, hold harmless BNB Israel Concierge Services, its affiliates, and its and their representatives, agents, directors, managers, officers, employees, and shareholders from and against all claims, liabilities, damages, losses and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (1) your access to or use of the Site and Services, (2) any Member Content submitted by you and (3) any breach or alleged breach by you of these Terms.

Term and Termination

By using the Site and Services, you agree that this Agreement becomes effective immediately. In the event that you decide to cancel your registration, you must send us an email and we will make our best efforts to terminate your registration within 30 days. BNB Israel Concierge Services reserves the right to modify or terminate these terms at any time, with or without notice. Notwithstanding any termination, the provisions, obligations, and restrictions related to the Services for both you and any other User shall remain in effect.
Furthermore, BNB Israel Concierge Services may, at its sole discretion, terminate your account or your use of the Service for any reason, including lack of use or if BNB Israel Concierge Services believes that you have breached the spirit of these Terms. BNB Israel Concierge Services may also discontinue providing the Services or any part of them, with or without notice, at any time. You acknowledge and agree that any termination of your access to the Services under any provision of these Terms may be affected without prior notice. BNB Israel Concierge Services may immediately deactivate or delete your account and all related information and files, and prohibit any further access to all files or the Services by you. However, any information posted by you may not necessarily be deleted from the Site. Finally, you agree that BNB Israel Concierge Services will not be responsible or liable to you or any third party for any termination of your access to the Services.

General

By agreeing to this agreement, you confirm that you have the legal capacity to do so. You acknowledge that you are not entitled to withhold any amounts owed to the Company against any amounts that may be owed to you. The Company reserves the right to assign or sub-contract their obligations under this agreement. The Company will not be held liable for any delay or failure to perform their obligations if the cause is beyond their reasonable control, including severe weather, endemic or pandemic, power or utility cut-off, burglary, natural disaster, strikes, governmental action, terrorism, war, civil unrest, or similar occurrences. This agreement supersedes any previous marketing information, representations, or agreements between the parties and represents the entire understanding between the parties. The parties agree that these terms are fair and reasonable. If any provision of this agreement is found to be invalid, the remaining provisions will remain in full force and effect. The Company may modify or amend this agreement in writing, and notice will be given by posting on the relevant page. This agreement will be construed in accordance with the laws of Israel. The failure of either party to enforce any provision of this agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this agreement.

Dispute Resolution

  1. Venue. Any disagreements between you and BNB Israel Concierge Services shall be resolved in Tel-Aviv and governed by Israeli law.
  2. Mediation. Before turning to arbitration or legal action, you and the Company agree to resolve any disputes or claims arising from this Agreement through mediation. The cost of mediation shall be split equally among the parties involved. If a party commences legal action without first attempting mediation or refuses to mediate after a request has been made, that party will not be entitled to recover attorney fees, even if they would have been available otherwise. Exceptions to this mediation provision are stated in paragraph v, below.
  3. Arbitration. If any disputes or claims arising from this Agreement cannot be resolved through mediation, you and the Company agree to resolve them through neutral, binding arbitration. The arbitrator must be a retired judge or justice, or an attorney with at least 10 years of experience in business law, unless both parties agree to select a different arbitrator. The decision of the arbitrator may be enforced by any court with jurisdiction.
  4. Attorney Fees. If either party engages in any legal proceeding or activity related to this Agreement or the rights and obligations of any party hereunder, the prevailing party will be entitled to recover reasonable attorney fees, costs, and expert fees and costs incurred or sustained by such party in connection with those efforts.
  5. Exceptions. Disputes within the jurisdiction of probate, small claims, or bankruptcy courts are exempt from the requirement to mediate and arbitrate. Filing a court action to obtain an order of attachment, receivership, injunctive relief, or other provisional remedy will not be considered a waiver or violation of the mediation and arbitration provisions.

Insurance

  1. During your stay, we highly recommend purchasing a Vacation Rental Damage Protection plan that covers accidental damages to the rental unit interior that may occur during your stay. If purchased, the policy will pay up to the policy limit shown on the confirmation. Any damages that exceed the policy limit or are not covered by the plan will be charged to the credit card on file. In the event that an insured person accidentally damages any real or personal property in the unit, the Insurer will reimburse the Insured for the repair or replacement cost of the damaged property up to the policy limit.
  2. Please note that Vacation Rental Insurance is not automatically included with your reservation. This type of insurance provides coverage for prepaid, nonrefundable expenses due to unforeseeable circumstances that may jeopardize your vacation investment and result in unplanned expenses. We strongly recommend that you purchase this valuable protection.
